1. Definitions and Applicability
These General Terms of Service ("Terms") apply to all offers, agreements, and digital services provided by Bramanjo ("Company", "we", "us"). By accessing our platform, purchasing software, or subscribing to our services, you ("Client", "User") explicitly accept these conditions.
Any deviations from these Terms are only valid if explicitly agreed upon in writing by an authorized representative of Bramanjo.
2. Offers, Subscriptions, and Invoicing
All prices quoted by Bramanjo are in Kenyan Shillings (KES) or United States Dollars (USD) , as specified on the billing page, and are exclusive of Value Added Tax (VAT) and other statutory levies unless stated otherwise.
Subscription fees are invoiced in advance. In the event of non-payment or failed card transactions by the due date, Bramanjo reserves the right to suspend or terminate access to the service or software features immediately without liability.
3. Intellectual Property Rights
All digital assets, source code, design elements, workflows, documentation, and software provided by Bramanjo remain the exclusive intellectual property of Bramanjo or its licensors.
The Client is granted a non-exclusive, non-transferable, and revocable license to use the services for internal business operations. You may not reverse engineer, duplicate, or redistribute our proprietary systems without explicit written consent.
4. Limitation of Liability ("AS IS" Provision)
To the maximum extent permitted by applicable law under the Laws of Kenya, Bramanjo provides its services, software, and platforms on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied.
Bramanjo shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from your use or inability to use our services.
In any case, Bramanjo's total aggregate liability under any contract or negligence claim shall be strictly limited to the total amount paid by the Client to Bramanjo during the three (3) months preceding the event giving rise to liability.
5. Data Protection and Privacy
Bramanjo operates under a strict privacy-first infrastructure model in compliance with the Kenya Data Protection Act, 2019. We do not deploy trackers, persistent profiling mechanisms, or third-party analytical cookies across our public platforms.
The collection of personal data is limited strictly and exclusively to identifiable information intentionally and explicitly submitted by the User through our formal platform contact forms. This data is leveraged solely to address direct inquiries, fulfill service requests, and fulfill system administration prerequisites.
6. Governing Law and Jurisdiction
These Terms, your use of the platform, and any dispute arising out of them shall be governed exclusively by and construed in accordance with the Laws of the Republic of Kenya. Any legal action, suit, or proceeding arising under or out of these Terms shall be brought exclusively before the competent courts in Nairobi, Kenya.
